Delivering the judgment on Thursday, November 28, 2024, Justice Owoeye ruled that Bobrisky’s claims lacked merit. The judge stated that the internet personality had failed to provide credible evidence to support his allegâtions against the EFCC. According to the court, “having evaluated the evidence placed before this Court by the Applicant, it is evident that the Applicant has failed to provide credible evidence to justify the award of the declaratory and injunctive reliefs sought by him.”
The judge further emphasized that the claims of vi0lation of fundamental rights against the EFCC and other respondents were not substantiated. “In the final analysis, I hope the claims of v!olation of fundamental rights against the 1st and 2nd Respondents were not made out of the affidavit evidence placed before this Court. The claim of the applicant against the 1st to the 2nd respondents hereby lacks merit and is liable to be dismissed. It is accordingly dismissed,” Justice Owoeye ruled.
The court also refused to award any dámages against the EFCC. Bobrisky’s initial arrest by the EFCC occurred on April 4, 2024, for alleged Naira ab¥se, leading to his convict!on and six-month sentence on April 12, 2024, by Justice Abimbola Awogboro of the Federal High Court in Ikoyi, Lagos.
This most recent decision emphasizes how crucial it is to present strong evidence in situations involving fundamental rights, particularly when contesting the activities of governmental organizations such as the EFCC. For the time being, Bobrisky’s legal dispute with the EFCC has come to a definitive end, and the contentious celebrity is now free to consider the court’s ruling.
